Advance Pricing Agreement (APA)

An Advance Pricing Agreement is a formal arrangement between a taxpayer and the tax authority that fixes the transfer pricing methodology to be applied to a specified category of international or specified domestic transactions for a defined period. India's APA programme allows for unilateral agreements, entered into solely with the Indian tax authority, as well as bilateral and multilateral agreements that also involve the tax authority of the counterparty jurisdiction, providing certainty on how related-party pricing will be treated well before a return is even filed.
